Terms of Service

1. General Information

These Terms of Service ("Terms") govern your use of the QRillium web application (the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.


2. Description of the Service

QRillium is a web-based application that enables users to create and manage QR codes for personal, commercial, and marketing purposes.

The Service is provided as a client-side application and does not require user registration.

We reserve the right to modify, limit, or discontinue any part of the Service at any time without prior notice.


3. Client-Side Operation and Data Responsibility

QRillium operates entirely within your browser environment.

  • Data is processed and stored locally on your device (e.g., via browser storage technologies)
  • QRillium does not store, process, or retain your data on its servers

You are solely responsible for:

  • Managing and securing your data
  • Creating backups of your projects
  • Preventing unauthorized access to your device or exported files

You acknowledge that data loss may occur at any time, including but not limited to browser resets, device changes, or user actions.

We assume no responsibility or liability for any loss of data.


4. No Account and No Recovery

The Service does not provide user accounts or identity management.

Accordingly:

  • We cannot recover lost data
  • We cannot restore projects
  • We cannot associate data with specific users

All risks associated with data storage and recovery remain with you.


5. Acceptable Use

You agree to use the Service only in compliance with applicable laws and regulations.

You must not use the Service to:

  • Create, store, or distribute illegal content
  • Conduct phishing, fraud, deception, or misleading practices
  • Distribute malware, malicious code, or harmful links
  • Violate intellectual property rights or third-party rights
  • Circumvent legal obligations or regulatory requirements

We reserve the right, at our sole discretion, to restrict or block access to the Service in case of suspected misuse.


6. User-Generated Content

All content encoded in QR codes is created solely by users.

You are fully and exclusively responsible for:

  • The content embedded in QR codes
  • The distribution and use of such QR codes
  • Any consequences arising from their use

QRillium does not monitor, verify, or control user-generated content and assumes no responsibility for it.


7. QR Code Functionality and Technical Limitations

QR codes generated through the Service may behave differently depending on:

  • Device type
  • Operating system
  • QR scanning application
  • Environmental or contextual factors

We make no representations or warranties regarding:

  • Compatibility with all devices or scanners
  • Correct interpretation of encoded data
  • Reliability in real-world use cases

Use of generated QR codes is at your own risk.


8. Third-Party Services

The Service may depend on or integrate third-party services, including but not limited to:

  • Cloudflare (hosting and content delivery)
  • Dropbox (optional integrations)
  • OpenStreetMap (map data and geographic information)

Such services are subject to their own terms and conditions and privacy policies.

In particular, OpenStreetMap data is provided by the OpenStreetMap Foundation and its contributors under applicable open data licenses.

We have no control over and assume no liability for the availability, accuracy, or functionality of third-party services.


9. Intellectual Property

All rights, title, and interest in the Service, including its software, design, and content (excluding user-generated content), are owned by the provider.

You retain ownership of any content you create using the Service.

You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.


10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind.

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability or uninterrupted access
  • Accuracy or reliability

11. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any damages, including but not limited to:

  • Loss of data
  • Loss of profits or revenue
  • Business interruption
  • Indirect, incidental, or consequential damages
  • Damages resulting from incorrect or misleading QR codes

Nothing in these Terms limits or excludes liability where it cannot be limited or excluded under applicable law.

Where liability is permitted to be limited, it shall be restricted to foreseeable and typical damages.


12. Compliance with Laws

You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to:

  • Data protection laws (e.g., GDPR)
  • Advertising and marketing regulations
  • Consumer protection laws

13. Availability and Access

We do not guarantee that the Service will be available at all times or without interruption.

We may suspend or restrict access to the Service for maintenance, security, or operational reasons at any time.


14. Changes to the Service

We reserve the right to:

  • Modify the Service
  • Introduce or remove features
  • Discontinue the Service entirely

without prior notice or liability.

The latest version will be published on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.


16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

If you are a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction shall be the provider’s registered location.


17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
